A BILL to amend article six, chapter seventeen-c of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
ten, relating to requiring that, before evidence from a
speed detecting device employing microwaves is admissible,
the political subdivision law-enforcement officer using the
device must have the same number of hours of training on the
device as state police officers are required to have using
the same type of device.
Be it enacted by the Legislature of West Virginia:
That article six, chapter seventeen-c of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section ten
to read as follows:
ARTICLE 6. SPEED RESTRICTIONS.
§17C-6-10. Microwave speed detecting device training for
political subdivision law-enforcement officers.
Before evidence from a speed detecting device employing
microwaves is admissible, the political subdivision law-
enforcement officer using the device must have the same number of
hours of training on the device as a state police officer would
be required to have using the same type of device.
NOTE: The purpose of this bill is to require that, before
evidence from a speed detecting device employing microwaves is
admissible, the political subdivision law-enforcement officer
using the device must have the same number of hours of training
on the device as state police officers are required to have using
the same type of device.
